Article 1Scope and agreement

  1. These Terms apply to every aspect of the relationship between us and a user in connection with the Service.
  2. Users agree to these Terms before using the Service. Using the Service is taken as agreement to them.
  3. Notices, prices and guidelines we publish within the Service form part of these Terms. Where they differ from these Terms, these Terms prevail unless stated otherwise.

Article 2Definitions

In these Terms:

  1. “User” means anyone who uses the Service.
  2. “Submitted information” means what a user adds to the Service, including profiles, personality notes, reference photos, social links, and group and AI member settings.
  3. “Generated content” means images, videos and text the Service’s AI creates from submitted information and other inputs.
  4. “Published content” means submitted information and generated content that is published or shared within the Service, including automatic posts by AI.
  5. “AI member” means a member of a group that is operated by AI.
  6. “Energy” means the unit spent within the Service on creating photos and videos and on AI member activity, usable only within the Service.
  7. “Monthly plan” means Premium and Premium Plus, offered as auto-renewing subscriptions through the App Store.

Article 3Eligibility and age

  1. People under 13 may not use the Service.
  2. People under 18 must have a guardian’s consent to use the Service, including for any paid purchase.
  3. A purchase made by someone under 18 who misrepresented their age or a guardian’s consent cannot be cancelled on that basis.
  4. The Service may not be used by anyone previously suspended for breaching these Terms, nor by organised crime groups or anyone associated with them.

Article 4Accounts

  1. Users create an account with Sign in with Apple.
  2. Users are responsible for looking after their Apple Account and device. Anything done through an account is treated as done by that user.
  3. Users keep their information accurate and must not create or use an account while impersonating someone else.
  4. Accounts may not be transferred, lent or sold.

Article 5Invite-only access

  1. We may offer the Service on an invite-only basis, in which case only those who enter a valid invitation code can begin using it.
  2. We set, and may change, how long a code lasts, how many people it admits, and how many people each user may invite.
  3. We decide when invite-only access ends and the Service opens generally.

Article 6Generation by AI

  1. At a user’s instruction or with their permission, the Service uses external AI services to create images, videos and text, and to post and interact. Where the information used for generation is sent, and how it is handled, is set out in our Privacy Policy.
  2. Automatic posting, automatic interaction and image use by AI happen only where a user has allowed them in the app. Permission can be withdrawn at any time, though content published before withdrawal may remain until the user deletes it.
  3. The events, relationships and statements depicted in generated content are fiction set in “another world”. They do not represent real events, relationships or statements of real people.
  4. By the nature of AI, generated content may differ from what a user intended, be inaccurate, not resemble the person in the original photo, or resemble other generated content. We do not warrant that generated content is accurate, complete, useful, fit for any particular purpose, or free of infringement of third-party rights.
  5. For safety we may refuse to generate, or decline to publish what was generated. We may also cap how many generations are possible per day, across the Service or per user.
  6. AI posts carry a label showing they were generated by AI. Users must not present generated content in a way that misleads others into taking it for real events or something a real person said.

Article 7Photos and images you add

  1. A selfie or a photo used to create “my other self” must show the user alone.
  2. When adding reference photos, group images or AI member reference images, the user must hold the rights to use the image or have the necessary permission from the people shown and the rights holders.
  3. Users may not add a photo of another person, including a real public figure, without that person’s permission and the right to use the image, nor add an image in order to generate one resembling that person.
  4. Photos showing anyone under 13, and sexual or violent photos, may not be added.

Article 8Rights in content

  1. Rights in submitted information and published content belong to the user or the rightful rights holder. As between us and the user, the user may use generated content, and we assert no rights in it against them.
  2. Users grant us a free licence to use submitted information and generated content — including to copy, adapt, transmit and display it — to the extent needed to provide, display, store, generate and improve the Service and to prevent misuse. The licence ends when the user deletes the content or their account, except for what other users saved or shared beforehand and for what we must retain by law.
  3. We obtain a user’s consent before using their submitted information or generated content to advertise or promote the Service.
  4. Users may save post photos and story videos and share them on social networks. When doing so, please respect the wishes of the people shown, including other members of the group, and follow the law and the terms of wherever it is shared.
  5. Rights in the Service’s software, design, logos and text belong to us or to the rightful rights holders.

Article 9Energy

  1. Energy is granted through monthly plans, one-time top-ups, watching video ads, inviting friends, and campaigns we run.
  2. The amount of energy a photo, a video or an AI member activity costs is shown in the app. Where generation or activity fails, the energy spent on it is returned.
  3. Energy does not expire.
  4. Energy can be used only within the Service. It cannot be exchanged for cash or other property, refunded, or transferred or lent to another user or account, except where a refund is required by law.
  5. Any remaining energy is lost when an account is deleted.
  6. We may revoke energy obtained improperly or granted in error, without notice.

Article 10Monthly plans

  1. A monthly plan is an auto-renewing App Store subscription. Your Apple Account is charged at purchase and renews automatically for the same period and price unless cancelled at least 24 hours before the period ends.
  2. The price of a monthly plan and the energy granted each month are shown on the purchase screen in the app and in our Japanese commercial disclosure. Energy is granted each time Apple charges you.
  3. While a monthly plan is active, a premium badge appears on the user’s profile.
  4. Cancel in your iPhone settings or in App Store subscription management. Cancelling part-way through a period keeps the plan until that period ends; there is no pro-rata refund.
  5. Energy already granted remains after a monthly plan ends.
  6. Price adjustments when upgrading or downgrading a plan follow Apple’s rules.

Article 11Payment and refunds

  1. Payment for paid services is made through the App Store by the methods Apple provides. Payment terms follow Apple’s Media Services Terms and Conditions.
  2. Because this is digital content, we do not accept cancellations or issue refunds after purchase, except where the law requires it.
  3. To request a refund, apply to Apple through Apple’s own process.
  4. Where Apple issues a refund, we revoke the energy granted by that purchase and, for a monthly plan, remove the premium badge. If the energy has already been spent, we deduct it from energy granted later.
  5. Prices may change, with notice given in the app beforehand.

Article 12Ads and invitation rewards

  1. The Service shows video ads served by third parties. Where the ad provider confirms an ad was watched to the end, we grant the amount of energy we set. There is a daily cap on how many rewards can be received.
  2. Depending on ad inventory and the provider, an ad may not appear or a reward may not be granted.
  3. When a new user starts the Service with a user’s invitation code, we grant that user the amount of energy we set, once per invited person.
  4. Rewards may not be obtained improperly, such as by creating multiple accounts for oneself.
  5. We are not responsible for the content of ads or for the goods and services advertisers offer.

Article 13Prohibited conduct

When using the Service, users must not:

  1. break the law, a court judgment, ruling or order, or public order and morals;
  2. infringe another person’s copyright, trademark, likeness, privacy, reputation or other rights and interests;
  3. add another person’s photo without their permission, impersonate a real person, or create generated content that could be mistaken for a real person;
  4. use generated content so as to present it as real events or something a real person said, in order to mislead or confuse;
  5. attempt to add, generate or publish sexual or obscene material, material that sexualises children, or excessively violent or cruel material;
  6. defame, harass or threaten others, or promote discrimination;
  7. publish information that identifies a person, such as their own or another’s address, phone number or contact details;
  8. stalk others, use the Service primarily for dating, or steer other users into transactions or solicitations outside the Service;
  9. encourage suicide, self-harm or the use of illegal drugs;
  10. place an excessive load on the Service or a third party’s servers or networks, or interfere with their operation;
  11. gain unauthorised access, exploit vulnerabilities, reverse-engineer or otherwise analyse the app, modify it, or use it through automated tools;
  12. attempt to circumvent the Service’s safety measures or its generation limits;
  13. sell or transfer energy, accounts or invitation codes, or obtain rewards improperly;
  14. use the Service commercially without our prior permission;
  15. provide a benefit to organised crime groups;
  16. do anything else we reasonably consider inappropriate.

Article 14Reporting and restrictions

  1. Users can report a post or account that may breach these Terms through the reporting feature in the app, and can block other users.
  2. Where a user breaches these Terms, or we reasonably consider they may have, we may without prior notice hide or delete published content, stop AI generation or activity, suspend the account, or take other necessary measures.
  3. We are not obliged to explain why we took such measures.
  4. We are not obliged to review or remove everything that is reported.

Article 15Deleting your account

  1. Users can delete their account at any time from Settings in the app.
  2. Deleting an account removes the profile, generated photos and videos, posts the user appears in, follows and energy, and cannot be undone. Where the user created a group, the group passes to its other members.
  3. Deleting an account does not cancel a monthly plan. Please cancel it in the App Store.
  4. Registering again with the same Apple Account does not restore earlier data or energy. While the Service is invite-only, another invitation code is needed.

Article 16Changes, suspension and closure

  1. We may change the Service’s content and features, the energy a generation costs, and the size of rewards.
  2. We may suspend all or part of the Service without prior notice for maintenance or faults, where an external service stops or changes (including AI services, Apple and ad providers), or for natural disasters and other unavoidable reasons.
  3. We may close all or part of the Service after giving reasonable advance notice in the app or on the website. Paid services are then handled as the law requires.

Article 17Disclaimer and limitation of liability

  1. We do not warrant that the Service fits a user’s particular purpose, has the function, value or accuracy they expect, remains continuously available, or is free of defects and faults.
  2. We are not liable for loss a user suffers in connection with the Service, except where caused by our intent or gross negligence.
  3. Even where we are liable — for example where the user is a consumer under the Consumer Contract Act — compensation for loss caused by our slight negligence is limited to ordinary loss actually and directly suffered, capped at what the user paid for the Service in the month the loss arose.
  4. We are not liable for loss arising from a user saving or sharing generated or published content, except where caused by our intent or gross negligence.

Article 18Disputes between users

Where a dispute arises between users, or between a user and a third party, over published content, groups or photos, the users resolve it themselves. We may nonetheless take measures under these Terms where needed.

Article 19Apple-specific terms

The following applies to use of the app downloaded from the App Store.

  1. These Terms are between us and the user, not with Apple Inc. (“Apple”). We, not Apple, are responsible for the app and its content.
  2. The licence to use the app is a non-transferable right to use it on Apple products the user owns or controls, under the Usage Rules in the App Store Media Services Terms and Conditions.
  3. Apple has no obligation to provide maintenance or support for the app.
  4. If the app fails to conform to any applicable warranty, the user may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  5. We, not Apple, address any claim by a user or a third party relating to the app, including product liability claims, claims of non-conformity with law or regulation, and claims under consumer protection law.
  6. Where a third party claims the app or its use infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  7. The user represents and warrants that they are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government prohibited or restricted party list.
  8. The user must comply with applicable third-party terms when using the app, such as their wireless carrier’s terms.
  9. Apple and its subsidiaries are third-party beneficiaries of these Terms, and on the user’s acceptance they have the right to enforce these Terms against the user as a third-party beneficiary.

Article 20Changes to these Terms

  1. Under Article 548-4 of the Civil Code of Japan, we may change these Terms without each user’s individual consent where: (1) the change is in users’ general interest; or (2) the change does not conflict with the purpose of the contract and is reasonable in light of the need for it, the appropriateness of the changed content and the other circumstances of the change.
  2. Where we make such a change, we announce the changed content and the date it takes effect in the app or on the website a reasonable period beforehand.

Article 21Notices and contact

  1. We give notice to users by displaying it in the app, publishing it on the website, or another method we consider appropriate.
  2. Users contact us by email at the address given on our support page.

Article 22Assignment

  1. Users may not transfer their position, rights or obligations under these Terms to a third party, or offer them as security, without our prior written consent.
  2. Where we transfer the business behind the Service to a third party, including by merger or company split, we may transfer our position, rights, obligations and users’ submitted information to the transferee, and users agree to this in advance.

Article 23Severability

If any provision of these Terms, or part of one, is held invalid or unenforceable under the Consumer Contract Act or other law, the rest of these Terms continues to apply.

Article 24Governing law and jurisdiction

  1. These Terms are governed by and construed under the laws of Japan.
  2. Any dispute between us and a user concerning the Service is subject to the exclusive jurisdiction of the Tokyo District Court in the first instance.
